Many consumers are now turning to pre workout supplements as a way to get stronger, have more energy, and improve athletic performance in the gym.

With this increase in consumption however, has come an increase in production. Many pre workout supplements are now on sale, all touting their own unique benefits.

Some pre-workouts, have received an incredible amount of media attention, however. USP Labs’ Jack3d Pre-Workout, in particular, has received ample legal pressure.

Most of this started several years ago, when their pre workout supplement was linked to numerous side effects, several banned ingredients, and even a few deaths.

In 2015, the U.S. Department of Justice began a large-scale probe into the company, USP Labs LLC, to determine whether they were complying with US supplement regulations.

Shortly afterwards, an 11-count indictment was filed in the U.S. District Court for the Northern District of Texas, charging USP Labs with the unlawful sale of dietary supplements.

“Regulators, retailers, and consumers trusted that the defendants were telling the truth about their products,” said Benjamin Mizer, principal deputy assistant attorney general. “All of these people were deceived. The deception put lives at risk,” he stated.

Marketed as a workout booster and weight loss supplement, Jack3d contained a chemical called 1,3 dimethylamylamine, or DMAA, which has since been banned by the FDA.

Touted as a “natural stimulant,” extracted from geranium, DMAA has been linked to numerous side effects, including rapid heartbeat, increased blood pressure, and even heart attacks.

Ever since then, the FDA has been on the prowl for other gray area pre-workouts which may be putting DMAA into their products. Many companies have been shut down.

Recently however, Dillian Whyte, a British heavyweight boxer and WBC interim world champion had his title suspended after testing positive for performance enhancing drugs.

According to the Independent, his last ban was likely linked to Jack3d:

“Hearn has been adamant that Whyte was cleared to fight by Ukad and added that ‘it doesn’t add up’ about the test result due to Whyte’s vocal stance against doping in boxing, although he has served a two-year ban previously after testing positive for a banned substance that was found in an over-the-counter pre-workout formula named ‘Jack3d’.”

This has outraged many fans, as they feel he is being done an injustice… and while some have stated that there may still be hope for his case, others are not so certain.

This new case with Dillian Whyte has brought the old USP Labs’ lawsuit back in the limelight, and according to the US Department of Justice, the owners just recently plead guilty.

“Five individual defendants and two companies pleaded guilty in Dallas to felony charges in connection with a scheme to fraudulently sell workout supplements,” they announced.

“All of the defendants played roles in developing, manufacturing, or marketing the popular workout and weight loss supplements known as Jack3d and OxyElite Pro, which were distributed by Dallas-based dietary supplement company USP Labs,” they stated.

As more supplements begin to hit the market, many doctors and licensed healthcare professionals are warning users about the side effects and potentially illegal ingredients.
